Smoke Free Illinois
 
On January 1, 2008, Public Act 095-0017 will go into effect in the State of Illinois. This act will ban smoking in all public places and places of employment in the entire state. As a result, Illinois will have one of the most restrictive smoking policies in the United States.
 
When the law goes into effect, Elk Grove Village's smoking ordinance will be pre-empted, but residents will see very little change. The current regulations banning smoking in public places and places of employment in the Village will remain in affect.
 
One change that will take place is smokers will have to stand 15 feet from any public entrance or entrance to a place of employment. Currently, the Village's Ordinance requires only 10 feet.
 
Smokers in violation of the act can receive a fine of $100.00 or more. Owners or operators of public places or places of employment in violation can be fined $250.00 or more for the first violation, $500.00 or more for the second violation within the same year, and not less than $2,500.00 for each additional violation within one year of the first violation.
